Brian Brown, president of the National
Organization for Marriage (NOM), on Friday called for Supreme Court
Justice Ruth Bader Ginsburg to recuse herself from an upcoming case
challenging gay marriage bans in four states.
“Justice Ginsburg has brought
disrepute on the Supreme Court and eliminated any pretext that she
will approach the marriage issue with an open mind when it comes
before her,” Brown said in a blog post. “Because of this
prejudice, federal law requires her to remove herself from hearing
the cases.”
In a Bloomberg Business interview
Wednesday, Ginsburg said that Americans are prepared to accept a
Supreme Court ruling striking down restrictive marriage bans.
“I think it would not take a large
adjustment,” Ginsburg
said.
“Justice Ginsburg has made it crystal
clear that she is going to rule in favor of redefining marriage when
these cases come before her,” Brown said. “We demand that she
comply with federal law and disqualify herself as she is required to
do. If she refuses, we will ask Congress to act.”
Brown, however, did not ask for
conservative justices to step down. Justice Antonin Scalia has made
his opposition clear. In 2013, Scalia told a group of lawyers that
there is no right to “homosexual conduct” in the United States
Constitution.
