The Ninth Circuit Court of Appeals in
San Francisco on Monday lifted a stay of a lower court ruling
striking down the state's ban on gay marriage.
“Plaintiff-Appellees' motion to
dissolve the stay in GRANTED, effective at 9 a.m. PDT Wednesday,
October 15, 2014,” the
court wrote in it's 1-page order.
While Idaho Governor Butch Otter, a
Republican, last week conceded defeat after the
Supreme Court lifted a temporary stay on the order – “Idaho
now should proceed with civility and in an orderly manner to comply
with any forthcoming order from the 9th Circuit,” he
said in a statement – his office returned to court on Monday
seeking to keep gay and lesbian couples from marrying in the state.
Attorney General Lawrence Wasden said
in a separate filing that he disagreed with the governor's
decision, saying that the Supreme Court's ruling means that the state
“cannot satisfy the stringent standards governing issuance of
stays.”
Plaintiff couples on Friday asked the
Ninth Circuit to end its stay on the lower court order.
